We want to be extra clear about what it means to be part of the Serenade community. We want you to know what you can expect from us, what we expect from you, and how together we can make Serenade better for you and your friends. By using the App, you agree to these Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use the App or any Serenade services. By using our Services (app or website) you are agreeing to the Terms and Conditions, Privacy Policy and Community Standards.

Eligibility To use our Services, you must:

• Be at least 13 years old. Depending on where you live, if you are under the age of consent in your country, a parent or guardian may also have to provide consent for you to use our Services.
• Have the legal authority to create an account on behalf of another person, company, organization, government, or other legal entity, if you’re not creating an account for yourself.

All references to “you” and “your” in the Terms will mean both you, the end user, and/or for accounts created on behalf of another person, company, organization, government, or other legal entity, the person who has legal authority to create and/or operate the account.

Our Privacy Policy describes what information you share with us, when it is shared, and how we handle it when you use our Services. By using our services you agree to the Privacy Policy, Terms and Conditions and Community Standards.

Content

You are solely responsible for the content you post, share, or otherwise make available through Serenade ("User Content"). By posting User Content, you grant Serenade a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in connection with the App.

You agree not to:

• Post, share, or otherwise make available any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Use the App for any illegal or unauthorized purpose.
• Interfere with or disrupt the App or servers or networks connected to the App.
• Violate any applicable laws or regulations.

If you make available any content that does not comply with what was previously stipulated and that does not align with our Community Standards, we have the right to remove it and we will remove it.

Intellectual Property

All intellectual property rights in our Services, including but not limited to software, design, graphics, and logos, are owned by Serenade. You may not use, reproduce, or distribute any content from the App or website without the express written permission of Serenade.

Third-Party Services

The App may contain links to third-party websites or services, including Instagram. Serenade is not responsible for the content, privacy policies, or practices of any third-party websites or services. By using any of our Services, you agree that Serenade shall not be liable for any damage or loss caused by or in connection with the use of any third-party websites or services.

Termination

Serenade reserves the right to suspend or terminate your account and access to the App at any time, for any reason, without notice. Upon termination, you must cease all use of the App and delete any copies of the App from your devices.

Limitation of Liability

To the fullest extent permitted by law, Serenade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any bugs, viruses, or the like that may be transmitted to or through our App by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

Changes to Terms

Serenade reserves the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.
